These Terms of Service (“Terms”) govern your access to and use of the Artnbuff Studio website and services (“Service”). By accessing, browsing, or using Artnbuff Studio, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. SERVICE DESCRIPTION

Artnbuff Studio provides a WordPress-based website building platform specifically designed for artists and creative professionals. Our Service includes:

  • DIY website builder tools with artist-ready templates
  • Managed hosting and website maintenance
  • Domain registration and management services
  • SEO optimization tools
  • E-commerce functionality for content monetization
  • Technical support and customer service
  • Optional professional website design services
  • Website portability and migration assistance

2. MEMBERSHIP PLANS AND PRICING

Artnbuff Studio offers tiered membership plans (Bronze, Silver, and Gold) with varying features and monthly subscription fees. Specific pricing and features are detailed on our pricing page. All membership plans include a 14-day free trial.

2.1 Pricing and Billing

  • Pricing is subject to change with 30 days’ written notice
  • Billing occurs on the anniversary of your subscription start date
  • DIY website setup begins at $1/month with no setup fee
  • Professional design services start at $250, plus applicable membership fees
  • All prices are in USD unless otherwise specified
  • While we strive to keep our plans affordable, Artnbuff Studio reserves the right to adjust membership pricing with 30 days’ notice.

2.2 Free Trial

  • The 14-day free trial is available to new members only
  • No payment information is required to begin your trial
  • Your trial will automatically convert to a paid subscription upon expiration unless cancelled

2.3 Cancellation and Refunds

  • Membership Plan
    • You may cancel your membership at any time through your account settings
    • Refunds are not available for partial months
    • Upon cancellation, you retain the ability to download your website content for migration purposes
    • Cancellation takes effect at the end of your current billing cycle
  • Expert Services
    • Refunds for Professional Design Services (Expert Setup) are available as follows: 100% refund if the request is made before work has commenced; 50% refund after the work on your website has been started; 0% refund once the website is finalized and handed over.

3. USER ACCOUNT AND REGISTRATION

3.1 Account Creation

  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized account access

3.2 Eligibility

  • You must be at least 18 years old to use this Service
  • If you are using this Service on behalf of a business, you represent that you have authority to bind that entity

3.3 Account Suspension
We reserve the right to suspend or terminate your account if:

  • You violate these Terms
  • Your account is used for illegal activities
  • You fail to pay subscription fees -site will be suspended after 3 days of non-payment, and deleted after 30 days.
  • You engage in abusive behavior toward our team or community

4. CONTENT OWNERSHIP AND RIGHTS

4.1 User Content

  • You retain full ownership of all content you upload to your website (“User Content”)
  • By using our Service, you grant Artnbuff Studio a limited license to host, display, and maintain your User Content
  • You are solely responsible for ensuring you have the right to upload any User Content
  • You warrant that your User Content does not infringe third-party intellectual property rights

4.2 Intellectual Property

  • Artnbuff Studio owns all intellectual property rights in the website builder platform, templates, tools, and design elements
  • You may not reverse engineer, decompile, or attempt to derive the source code of our platform
  • Our templates are licensed for your use but remain our property

4.3 Website Portability

  • Artnbuff Studio uses open-source WordPress technology
  • You own the domain name and database of your website
  • You may export your website data and migrate to another hosting provider at any time
  • We will provide reasonable technical assistance to support website migration

5. PROHIBITED CONTENT AND CONDUCT

You agree not to use the Service to:

  • Upload, display, or promote illegal content or activities
  • Create content that is defamatory, abusive, or harassing to individuals or groups
  • Engage in fraud, deception, or impersonation
  • Infringe upon intellectual property rights of third parties
  • Distribute malware, viruses, or harmful code
  • Collect personal information of others without consent
  • Engage in spam, phishing, or other deceptive practices
  • Violate applicable laws and regulations
  • Create adult content, explicit material, or content exploiting minors
  • Promote violence, terrorism, or illegal activities
  • Circumvent security measures or attempt unauthorized access

6. CONTENT MODERATION AND REMOVAL

6.1 Right to Moderate
Artnbuff Studio reserves the right to review, monitor, and remove User Content that violates these Terms or applicable laws, without liability.

6.2 DMCA Compliance
If you believe your copyrighted content has been infringed upon, please submit a DMCA takedown notice to our designated agent with the following information:

  • Your name, contact information, and physical address
  • Description of the copyrighted work
  • Description of where the infringing content appears
  • Statement of good faith belief
  • Declaration under penalty of perjury
  • Your signature (electronic or physical)

6.3 Counter-Notice
If your content has been removed, you may submit a counter-notice if you believe the removal was in error.

7. MULTISITE FEATURES AND LIMITATIONS

Artnbuff Studio operates on a WordPress multisite network architecture, which provides the following capabilities and limitations:

7.1 Capabilities

  • Independent website management for each member while benefiting from centralized hosting and updates
  • Shared security infrastructure and regular WordPress core updates
  • Unified support system while maintaining site isolation
  • Efficient resource management and scalability

7.2 Limitations

  • Plugin availability may be restricted to ensure network stability and security
  • Some customization options may be limited compared to self-hosted WordPress
  • Certain third-party integrations may require approval or may not be available
  • Network-wide security policies apply to all sites
  • Migration from our multisite network to standalone WordPress hosting may require technical adjustments

7.3 Network Maintenance

  • Maintenance windows may require temporary Service downtime
  • Updates to WordPress core and shared infrastructure are performed by Artnbuff Studio
  • We will provide notice of scheduled maintenance 48 hours in advance when possible

8. SERVICE AVAILABILITY AND UPTIME

8.1 Uptime Commitment
Artnbuff Studio aims to maintain 99.5% uptime, excluding scheduled maintenance and force majeure events.

8.2 Service Interruptions

  • We are not liable for service interruptions due to circumstances beyond our reasonable control
  • Unannounced downtime exceeding 6 hours may qualify for account credit (up to one month’s subscription fee)
  • Credits must be requested within 30 days of the outage

8.3 Scheduled Maintenance

  • Maintenance is typically performed monthly during off-peak hours
  • Emergency maintenance may occur with minimal notice if security is compromised

9. SUPPORT AND SERVICES

9.1 Technical Support

  • Support is available during business hours (Monday-Friday, 9 AM-5 PM EST)
  • We commit to responding to support requests within 24 business hours
  • Premium support options may be available for Gold tier members

9.2 Professional Design Services

  • Design services are provided on a per-project basis with separate agreements
  • The designer will work with you to create a customized website within agreed specifications
  • Design revisions are limited to the scope outlined in your service agreement

9.3 Training and Resources

  • Educational resources and tutorials are available in our knowledge base
  • Live training sessions may be offered periodically

10. LIMITATIONS OF LIABILITY

10.1 Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 Limitation of Liability
ARTNBUFF STUDIO SHALL NOT BE LIABLE FOR:

  • Direct, indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Unauthorized access to your website or data breaches
  • Service interruptions or downtime
  • Damage to User Content
  • Third-party claims

OUR TOTAL LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL FEES YOU HAVE PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

10.3 Exceptions
Some jurisdictions do not allow limitations of liability. If you are in such a jurisdiction, the above limitations may not apply to you.

11. INDEMNIFICATION

You agree to indemnify and hold harmless Artnbuff Studio, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your User Content
  • Your violation of applicable laws or third-party rights
  • Your interaction with other users

12. THIRD-PARTY SERVICES AND INTEGRATIONS

12.1 Third-Party Providers

  • Artnbuff Studio may integrate with third-party services (payment processors, domain registrars, email providers, etc.)
  • You may be subject to those providers’ terms of service and privacy policies
  • Artnbuff Studio is not responsible for third-party service failures or data handling

  • We do not endorse or control external websites
  • You use external links at your own risk

13. AFFILIATE PROGRAM

13.1 Affiliate Membership

  • Artnbuff Studio offers an affiliate program for members who wish to refer new customers

  • Commission structures are detailed in the affiliate program agreement

13.2 Affiliate Conduct

  • Affiliates may not misrepresent the Service
  • Affiliates may not use spam, deception, or prohibited marketing methods
  • Violations may result in removal from the affiliate program

15. MODIFICATIONS TO TERMS

Artnbuff Studio reserves the right to modify these Terms at any time. Material changes will be announced with 30 days’ notice.

15.2 Continued Use
Your continued use of the Service following any modifications constitutes acceptance of the new Terms.

16. DISPUTE RESOLUTION

16.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles.

16.2 Arbitration
Any disputes arising from these Terms shall be resolved through binding arbitration administered by JAMS, rather than in court, except for:

  • Claims for injunctive relief
  • Claims for intellectual property infringement
  • Claims brought by Artnbuff Studio for unpaid fees

Arbitration shall be conducted in New York County, New York, with each party bearing its own costs.

16.3 Class Action Waiver
You agree that any arbitration shall be conducted on an individual basis, not as a class action, collective action, or representative action.

17. COMMUNITY STANDARDS

17.1 Respectful Interaction

  • Users are expected to treat other community members with respect
  • Harassment, bullying, or abusive behavior is prohibited
  • We reserve the right to remove users who violate community standards

17.2 Marketplace Standards

  • For users selling through Artnbuff Studio or our marketplace, accurate product descriptions are required
  • Intellectual property rights must be respected in all marketplace listings
  • Fraudulent or deceptive transactions may result in account termination

18. TERMINATION

18.1 Termination by You

  • You may terminate your account at any time through account settings
  • You will retain access until the end of your current billing period

18.2 Termination by Artnbuff Studio
We may terminate your account immediately if:

  • You materially breach these Terms
  • Your account is used for illegal activities
  • Your conduct harms other users or our reputation

18.3 Effects of Termination

  • Upon termination, you lose access to the Service
  • You may download your website data within 30 days of termination
  • After 30 days, archived data will be securely deleted

19. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid.

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Artnbuff Studio regarding the Service and supersede all prior understandings and agreements, whether written or oral.
